CCJL Submits Amicus Brief to Colorado Supreme Court

April 2 -The CCJL continues to be active in the Colorado Supreme Court, where the amicus brief they submitted in the case, Brodeur v. American Home Assurance Co., has been accepted. The brief, which is available at  CCJL.org website, asks the Court to consider the implications of broadening the definition of "public impact," a requirement for filing cases under the Colorado Consumer Protection Act (CCPA).

The CCJL brief argues that the workers' compensation insurance in question in the case is not the type of business the CCPA was intended to cover. Detailed contracts and the business-to-business nature of the transaction separate insurance coverage conflicts from the more traditional consumer fraud that the bill was intended to fight. Oral arguments will be heard later this year.

"Colorado Citizens for Accountability" Set to

Oppose Tort Reform

(Courtesy Colorado Civil Justice League)  In a press conference on Friday, a new group, the Colorado Citizens for Accountability (CCA) announced that it will organize to oppose additional tort-reforms in Colorado. "I assure you we won't sit by in silence and watch well-organized and well-funded assaults on the civil justice system by companies with money and power," CCA Director Patty Skolnik told the Denver Post.

 

The Colorado Civil Justice League has been on hand to learn more about this group and its efforts to dilute the important tort reforms passed since the late 1980's. Those reforms have been important to containing health care costs while maintaining patients' access to the courts.
