| CCJL Submits Amicus Brief
to Colorado Supreme Court
April 2 -The CCJL continues to be
active in the Colorado Supreme Court, where the amicus brief
they submitted in the case, Brodeur v. American Home
Assurance Co., has been accepted. The brief, which is
available at
CCJL.org website,
asks the Court to consider the implications of broadening the
definition of "public impact," a requirement for filing cases
under the Colorado Consumer Protection Act (CCPA).
The CCJL brief argues that the
workers' compensation insurance in question in the case is not
the type of business the CCPA was intended to cover. Detailed
contracts and the business-to-business nature of the transaction
separate insurance coverage conflicts from the more traditional
consumer fraud that the bill was intended to fight. Oral
arguments will be heard later this year.
